The Judge made a Complicated Decision
Judge Epstein didn’t seem completely convinced by his own ruling. In fact, he openly admitted that this wasn’t a cut-and-dried win for the defense. In his written statement, obtained by Rolling Stone, the judge acknowledged that the situation wasn’t easy to judge especially because of how the claims were presented.
“There is no demand for a particular sum of money, although that is not enough to protect the Letters,” Epstein explained. He noted that Buzbee’s request for mediation was strictly focused on the alleged sexual abuse claims, not on any unrelated dirt or personal threats.
Importantly, Epstein ruled that while the situation may have involved serious criminal allegations, Buzbee and his client never crossed the line into threatening to report Jay-Z to the police unless he paid them. That, legally speaking, is what defines criminal extortion. Instead, the judge classified it as a civil settlement negotiation, which even when silence is exchanged for money is not considered extortion under California law.

Jay-Z Isn’t Backing Down
While some may see this dismissal as the end of the road, Jay-Z’s legal team made it clear that they’re not walking away. His attorney, Alex Spiro, came out swinging after the judge’s decision, criticizing how California law was interpreted particularly around the statements made by investigators.
“We are surprised and disappointed by this ruling, which turns on the misapplication of California law on the admissibility of the investigators’ statements,” Spiro told Rolling Stone.
And here’s where it gets even more interesting: Spiro claims that if those investigator statements had been allowed into evidence, the judge might have ruled very differently. According to Spiro, those statements would have shown not only that Jay-Z had nothing to do with the alleged assault, but also that Buzbee *knew* his client was falsely accusing him.
In the judge’s own words, had those statements been allowed, the outcome would have changed dramatically.
